Terms of Service

These terms are an agreement between you and Mad Ladd Sounds ("we", "us"), the operator of myTourManager. They cover your use of the myTourManager website, web app and mobile and desktop apps (together, the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy.
1. Who can use the Service
You must be at least 13 years old (16 in the EU and UK) to use the Service, and old enough to form a binding contract where you live. If you use the Service on behalf of a venue, band, agency or other organization, you confirm that you're authorized to accept these terms for it.
2. Your account
Keep your sign-in details secure and tell us promptly if you think your account has been misused. You're responsible for activity under your account. Give accurate information, and keep it up to date.
3. Venue and artist profiles
- Many venue and artist profiles start from public and licensed data sources and may be incomplete or out of date. We don't guarantee their accuracy.
- Claim a profile only if you're entitled to manage it, for example as its owner, a member of the band, or an authorized manager or booker. We may ask for evidence, and we may refuse, suspend or remove a claim.
- Information you add to a profile you manage takes priority over imported data and won't be overwritten by our imports.
4. Bookings
myTourManager helps artists and venues find each other and organize shows. Any booking or performance agreement is between the artist and the venue (or their representatives). Mad Ladd Sounds is not a party to it, is not a booking agent, and is not responsible for whether either side performs, pays or meets its obligations. Make your own arrangements for contracts, deposits, insurance and permits.
5. Your content
You keep ownership of the content you add, such as descriptions, photos, messages and booking details. You give us a worldwide, non-exclusive, royalty-free license to host, store, display and share that content as needed to run and promote the Service (for example, showing your venue profile to artists). This license ends when you delete the content or your account, except for copies other users already have (such as booking messages) and backups that expire on their normal schedule. You confirm you have the rights to the content you add and that it doesn't break the law or anyone else's rights.
6. Acceptable use
Don't use the Service to:
- impersonate a venue, artist or person, or claim a profile you're not entitled to;
- send spam, harass people, or post content that is unlawful, hateful, or infringes someone's rights;
- scrape, copy or resell data from the Service in bulk, or use it to build a competing database;
- try to access accounts or systems you're not authorized to use, or interfere with the Service's security or operation.
We may remove content or suspend or close accounts that break these terms.
7. Third-party services
The Service relies on third parties, such as sign-in with Google or Apple, and links to other websites. Their own terms and policies apply to your use of them, and we're not responsible for them.
8. Changes to the Service
The Service is under active development. Features may change, be added or be removed, and some may be marked as early access. We'll try to give notice of significant changes that affect you.
9. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the Service will be uninterrupted or error-free, or that information on it (including venue details and availability) is accurate.
10. Limitation of liability
To the fullest extent the law allows, Mad Ladd Sounds will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or bookings. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $100. Some places don't allow these limits, so they may not fully apply to you.
11. Ending your use
You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these terms or if we stop providing the Service. Sections 4, 5 (for content already shared), 9, 10 and 12 continue to apply after your account ends.
12. General
If part of these terms can't be enforced, the rest still applies. Not enforcing a term isn't a waiver of it. These terms are the entire agreement between you and us about the Service. Where your local law gives you rights that can't be waived by contract, nothing in these terms takes those rights away.
13. Changes to these terms
We may update these terms. We'll change the "Last updated" date and, for significant changes, notify you in the app or by email before they take effect. If you keep using the Service after that, you accept the new terms.
